While I'm not a legal expert, unles it's a direct copy there should be no legal problems. The law can't limit tha souces of an artist's inspirations. Also, it's wel known that artists re always 'stealing', 'borrowing' etc. ideas from each other. If you actually use a photograph in your artwork you may have to consider if you might need a model release or the photographer's permission, but that's only if you use the actual photograph. That's my understanding at least. If someone else has direct legal knowledge listen to them. I hope this helps though.
